REAL PROPERTY MANAGEMENT
The Board shall manage the School District’s real property considering the School District’s best interests and immediate and future needs. At its discretion, the Board of Education may lease, rent, purchase, or sell School District property. All real estate transactions shall be conducted in accordance with applicable law and this Policy, unless waived by the Board.
Acquisition
The Board of Education will discharge its legal responsibility to acquire necessary school sites by the following method:
- Requiring reports from the Superintendent as to current and future needs for elementary schools, middle schools, K-8 schools, senior high schools, and for such other facilities as appear to be necessary.
- Consulting, through the Superintendent, with other public agencies whose activities bear on education or community development.
- Requiring, when appropriate, appraisal reports or other customary methods of determining the value of the property based upon comparable sales in the area or other reliable sources, including recommendations as to necessary Board action.
- Taking action as necessary to institute eminent domain proceedings to effect the satisfactory acquisition of property for school purposes, only after reasonable negotiations fail and in accordance with applicable law.
- Assuring property acquired by dedication by various governmental bodies meets the School District’s needs and is conveyed in accordance with applicable law. Generally, such properties shall be free of all liens, encumbrances, encroachments, easements, rights-of-way, except those easements and rights-of- way granted for utility purposes or those recorded exceptions that do not unreasonably interfere with the School District’s intended use; and, shall not result in additional costs to the District (including but not limited to the need for adjacent infrastructure, drainage, or utilities).
Sale/Disposition
Sales should be conducted through a public process and in accordance with applicable law. The Board of Education reserves the right to reject any or all proposals, offers or bids.
Delegation
The Board delegates to the Superintendent or designee the authority to negotiate and enter appropriate agreements with local governments and utility providers for temporary construction and permanent easements or licenses to enter and use School District property for limited purposes and time.
