IMPASSE PROCEDURES

When it becomes apparent that the parties are unable to reach a satisfactory agreement, they may declare that an impasse exists, and the following procedure shall be followed for mediation and/or advisory fact finding:

1. The issues in dispute shall be submitted to a mediator for the purpose of inducing the Board and the organization to make a voluntary agreement. The parties may mutually agree to a mediator. If they cannot mutually agree, the selection of a mediator shall be made by written request to an appropriate provider of mediators. The request should ask for an odd number of names of multiple qualified mediators, to be submitted to the Board and the organization. From among these, a mediator shall be selected by agreement between the Board and the organization. If there is no agreement, the Board and the organization shall alternately strike names from the list until one name remains.

2. The format, dates, and times of meetings will be arranged by the mediator, and such meetings will be conducted in closed sessions.

3. The mediator shall meet with representatives of the Board and the organization, either separately or together.

4. If mediation fails in whole or in part, the mediator shall report the issues that remain in dispute to the respective parties.

5. The cost for services of the mediator, including per diem expenses, if any, and necessary and actual travel expenses, shall be shared equally between the Board and the organization.

6. If mediation is unsuccessful in assisting the parties to reach an agreement, then either party may request in writing that the issues that remain in dispute be submitted to an advisory factfinder. Unless the parties agree otherwise, the method of selection of the factfinder shall be the same as that for the selection of a mediator as described above.

7. The factfinder will have authority to hold meetings and confer with any parties deemed advisable, but the factfinder shall be without power or authority to make any decision that requires the commission of an act prohibited by law or that is in violation of the terms of a bargaining agreement. 

8. The factfinder shall provide a written report with the factfinder’s advisory recommendation to the two parties so that the parties can meet to review it and attempt to reach agreement. Such recommendation shall be advisory only and not binding on either party.

9. The cost for services of the fact-finder, including per diem expenses, if any, and necessary and actual travel expenses, shall be shared equally between the Board and the organization.
