SCHOOL BOARD NEGOTIATING POWERS AND DUTIES
The Board, as the duly constituted representative of the people and as the agent of the state, is legally responsible for the conduct of public education in the School District, and the authority to make final decisions as provided by law may not be delegated, limited, or abdicated.
The Board's rights include, but are not limited to, all matters relating to the management of the schools and their administration; the employment and direction of staff; the determination of the School District’s program of instruction; and, the right under Article X, Section 20 of the Colorado Constitution to take action regarding multi-fiscal year financial obligations.
Further, the management of the School District for all purposes is vested solely and exclusively in the Board and shall not in any way be abridged except as specially limited by the express term of an agreement that is permissible in the School District’s policy framework. Even when the School District enters into a negotiated agreement, the School District preserves and retains solely and exclusively all of its constitutional, statutory, and common law rights and responsibilities to manage the District, and to take any and all necessary action to carry out the mission of the District.
